In Democratic Republic of Congo's (DRC) eastern district of North Kivu, militias loyal to dissident General Laurent Nkunda raided an army position. In the fighting that followed 20 rebels were reportedly killed. Fighting continued into a third day on Friday, as the displaced population rises to some 200,000. DRC army head General Dieudonne Kayembe says he has no hope for a peaceful solution, and force is the only option. Nkunda accuses the UN of siding with the government, following its agreement to help disarm the rebels by force. Long-standing ethnic conflict underlies the fighting.

The Ogaden National Liberation Front (ONLF) reports that Ethiopia is using helicopter gunships to attack villages, causing many civilian casualties, and displacing residents. Last weekend Sudan President Omar al-Bashir threatened to rearm militias. This week, Sudan People's Liberation Movement (SPLM) leader and national Vice President Salva Kiir says that al-Bashir has done just that, and is mobilizing for war.  Thursday, a police notice warned residents they would be forcibly disarmed if they did not hand over arms to the Sudanese army by this weekend, raising the threat of yet more bloodshed.

Colombia's government has abruptly halted Hugo Chavez's mediation efforts for the release hostages held in the jungle by the Revolutionary Armed Forces of Colombia (FARC). Relatives of the hostages and the French government have asked President Alvaro Uribe to reconsider, as Chavez's participation seemed the last hope for an agreement. Chavez is now suggesting that FARC release the hostages to Venezuela or France.

Designated terrorist organization Al-Haramain Islamic Foundation and two of its attorneys have appealed against federal officials over NSA's warrantless communications surveillance program. The ninth court of appeals denied defendants' motion to dismiss and ruled, "...we agree with the district court that the state secrets privilege does not bar the very subject matter of this action. After in camera review and consideration of the government's documentation of its national security claim, we also agree that the Sealed Document is protected by the state secrets privilege. However, we reverse the court's order allowing Al-Haramain to reconstruct the essence of the document through memory. Such an approach countenances a back door around the privilege and would eviscerate the state secret itself. Once properly invoked and judicially blessed, the state secrets privilege is not a halfway proposition. Nonetheless, our resolution of the state secrets issue as applied to the Sealed Document does not conclude the litigation. Al-Haramain also claims that FISA preempts the common law state secrets privilege. We remand for determination of this claim, a question the district court did not reach in its denial of the government's motion to dismiss.

In southern Thailand on Monday two attacks in Yala left three rubber tappers dead. Tuesday in Yala a bomb exploded under a cement bench in front of a restaurant, injuring six.  In Narathiwat four suspected bomb planners were arrested. Security was stepped up, including more raids, following warnings of attacks during weekend festival. There were several arrests on Thursday. In Yala, a scrap warehouse owner was killed in a drive-by shooting.  On Friday in Yala a former provincial administrator was shot twice in a drive-by attack. In Narathiwat eight suspected rebels were arrested. More suspects were detained in Narathiwat on Saturday, including three suspected of planning a bomb at a festival. A Malaysian man was among those detained.

In Gaza on Monday two Palestinian militants attempting to infiltrate Israel were shot and killed. On Tuesday the Israeli army attacked the southern city of Khan Younis, injuring at least four Palestinians. One of them, a member of the al-Qassam Brigades, died of his injuries on Wednesday. Wednesday night a Palestinian police vehicle was blown up, causing no injuries. On Thursday Israeli troops shot and killed an unarmed Palestinian. A series of explosions overnight to Saturday have left at least eight injured. On Saturday the Israeli army shot and killed two brothers running toward their farmland, which the troops were bulldozing. An Israeli drone attempted an assassination against Hamas fighters, but there were no fatalities. This morning Israeli troops killed one member of Islamic Jihad and one Popular Resistance Committee member.

Violence also continues in Iraq. On Monday a roadside bomb near a small bus in Baghdad's eastern Baladiyat district left one person dead and seven injured. In Baiji a parked car bomb exploded near a policeman's home, injuring five, including two children. Iskandariya police discovered a weapons cache in a Shiite mosque. In Samarra, the bodies of four men tortured and shot were sent to the hospital, and nearly the body of police major Saad Jumaa was found after his kidnapping. Near Suwayra police found four bodies, tortured and shot.

On Tuesday in Baghdad's eastern Baladiyat district a roadside bomb injured three people. Also in eastern Baghdad a roadside bomb detonated near a patrol, killing a US soldier and an Iraqi interpreter, and injuring three US soldiers. In western Mansour district a 15-year-old boy shot and injured two men. In southwestern Bayaa district a car bomb killed one and injured six. Six bodies were found across the city. Dhuluiya police found the bodies of three men bound and shot. Gunfights in Haditha left three suspected al Qaeda, and one policeman dead, and five militants detained. The Iraqi defense ministry reported that the army killed two suspected insurgents and arrested 154 across the country. The US military reports their operations against al Qaeda left 12 suspected insurgents dead, and five detained.

On Wednesday in the western Mansour district of Baghdad a roadside bomb injured three policemen. In southern Saidiya district the Iraqi army found six decomposed bodies. Diwaniya police arrested 30 people suspected of attacks against Iraqi security forces. Outside a Ramadi courthouse a car exploded, killing at least six people, and injuring more than a dozen.

On Thursday in the Green Zone insurgents fired ten mortar bombs causing several casualties. In central Baghdad a roadside bomb targeted an army patrol, injuring two soldiers, while another injured three people, including a policeman. In eastern Talbiya district a roadside bomb injured two people. In southern Baghdad al Qaeda militants killed eight members of a neighborhood patrol and two Iraqi soldiers. In the southern Diyala Bridge district a roadside bomb injured two policemen. In western Yarmouk district teenagers on a motorbike threw a grenade at a police checkpoint, injuring a soldier. Four bodies were found across the city. In Balad, a mortar bomb landed inside a coalition military base, killing an Iraqi citizen and injuring two. Hilla police found the body of a shot man. Kirkuk police found the tortured and decapitated body of a man. Nearby, gunmen killed a municipal councilman as he was driving. Kut gunmen on a motorbike killed a doctor working with the US military. Mosul police found the decapitated body of a Tikrit university lecturer, and a car bomb targeting a police patrol killed two civilians and injured 12, including two policemen. A roadside bomb killed one policeman and injured a second.  Neighborhood security and police in Ramadi detained ten suspected al Qaeda, and police found at least 13 decomposing bodies in a mass grave. Coalition forces said they killed one insurgent and detained 10 suspects during operations targeting al Qaeda in central and northern Iraq. Iraqi soldiers detained 35 suspected militants in Kerbala.

On Friday a bomb hidden in a box containing birds killed 13 people and injured 57 others at a popular pet market in central Baghdad. The US blames Iranian-backed Shia militants for the attack. Six bodies were found across the city. In Dhuluiya, three tortured and shot bodies were pulled from the Tigris.  Kut's main hospital received eight decomposed bodies over three days. In Jurf al Sakhar, a parked car bomb near the Atta Allah mosque killed two worshippers and injured two more. In Mosul, two suicide car bombs killed 21 people, including at least  six police, and injured several more. On the road between Basra and Nassiriya, gunmen kidnapped the manager of a grain company in Dhi Qar province. The US military reported detaining four gunmen, including two they characterize as known extremist company commanders.

On Saturday in central Baghdad a roadside bomb injured two members of the Interior Ministry's anti-crime unit. In southern Jadiriya district a roadside bomb injured an Iraqi soldier and two civilians. Four bodies were found across the city. Falluja police found two bodies, tortured and shot.  Near Samarra a car bomb killed three police rangers and injured 11.  In Tuz Khurmato, the body of a policeman was found shot dead, two days after his kidnapping. The US military reported killing one militant and detaining ten during operations in northern Iraq and Baghdad.

Today in central Baghdad a car bomb near the Health Ministry killed nine people and injured 30.  In northern Waziriya district a roadside bomb injured two civilians. When Iraqi security forces responded, a second roadside bomb exploded, killing one soldier and injuring six others. In Falluja, an attack injured a policeman. Four gunmen were detained. In Mosul, a roadside bomb targeting a US patrol injured six people.

The US military is providing evidence and will recommend criminal charges to Iraqi judges, to determine whether to proceed with US charges against an award-winning Associated Press photographer Bilal Hussein, who was detained in 2006 on suspicion of helping Iraqi insurgents. The Pentagon says they have proof that he is a "terrorist media operative" who infiltrated AP, which has been denied access to Hussein and the evidence against him

The Public Committee Against Torture in Israel issued an urgent letter to Israeli Attorney General Menachem Mazuz, demanding he take action against the physical torture they say was inflicted upon Palestinian detainee, Amaad Hutari, by Shin Bet interrogators. Hutari says that his hands had been restrained for a prolonged period of time, causing paralysis.

In the Indian state of Uttar Pradesh, three coordinated explosions ripped through courthouses in Gaizabad, Lucknow, and Varanasi. The series of explosions left at least 15 people dead and many others injured. Pakistan-based Jaish-e-Mohammed (JeM) is suspected, but those responsible have not been confirmed. Ahead of this meeting, the emergency Palestinian government led by Prime Minister Salam Fayad has laid out a blueprint of security, fiscal and political reforms. The Israel Prison Service (IPS) has made public the names of the Palestinian prisoners authorized for early release by the government as a goodwill gesture ahead of the meeting. Israel has also sent weapons to Abbas's security forces and lifted a ban on flowers and strawberries exported from Gaza. Egyptian President Hosni Mubarak, Jordan's King Abdullah II and Mahmoud Abbas, met on Thursday to discuss the forthcoming meeting. The stakes for Annapolis, as for prior Middle Eastern peacemaking efforts, are high. They report that US government contracts for work in Iraq and Afghanistan have grown more than 50 percent annually, from $11 billion in 2004 to almost $17 billion in 2005 and more than $25 billion in 2006. While the dollar amounts and complexity of war-related contracting has been going up, oversight has been going down. The Government Accountability Office has many examples, including the finding that the Federal Procurement Data System does not include any of the millions of dollars in contracts originating in Baghdad. The Center first reported on war contracting in 2003, and was the first to show that Halliburton was the largest single contractor in Iraq. That is still true today. Former Halliburton subsidiary, KBR, Inc. (formerly Kellogg, Brown and Root) earned the top spot among individual companies and subsidiaries. KBR’s $16 billion is overshadowed by $20.4 billion in contracts that went to unidentifiable "foreign contractors" that representing about 45 percent of the money awarded to the top 100 contractors.

This week representatives of the US Mine Safety and Health Administration (MSHA) presented the Utah Mine Safety Commission current findings regarding the Crandall Canyon disaster, including evidence of the mine bounce that blew out supporting pillars. This event occurred the March before the fatal 6 August collapse, and was not reported to MSHA, nor were subsequent mining plans adjusted to take this event into account. Investigations continue. The mine, where the six workers were entombed, was sealed in early October. Utah had not previously been informed of this, and MSHA emphasized this did not mean the bodies could not be recovered in the future.

Standard and Poors earlier this month released a Request for Comment on Enterprise Risk Management Analysis For Credit Ratings Of Nonfinancial Companies. This week TowersPerrin says it expects a broad range of companies will now make ERM a standard part of business or risk rating downgrade.

Aon Global Risk Consulting issued a report that said companies are slow to make use of enterprise risk management (ERM) techniques, with only one in 10 companies in the Americas and Europe having fully integrated an ERM strategy, even though government regulators and corporate stakeholders are demanding they address and mitigate enterprise-wide risks.

Another survey from the Conference Board found that among companies it surveyed that 55 percent said their corporate boards are a top driver of ERM programs, up from 49 percent two years ago, but ERM is not being integrated in corporate cultures.

The judge in the Uphaar Cinema case (above) called for further investigation of government officials that collude with businesses to bypass legal requirements. Public corruption in permitting and failure to uphold safety requirements, presents a risk to the public. Although fire safety measures have been improved, the threat persists. Evacuation plans without fire drills, lack regulations, and other dangers remain.

UK Prime Minister Brown promised in July to increase funding for flood prevention from GBP600 million to GBP800 million. However, this money will not be available until 2010/11. In an official submission to the Pitt Review into the summer floods, the Local Government Association has warned a three-year delay in this investment could lead to a repeat of this summer's floods, and consequently higher costs for the taxpayer.

Risk Management Solutions (RMS) has confirmed its modeled hurricane activity rates for 2008 to 2012 - the medium-term view.  Their findings suggest that the average risk of hurricanes landfalling in the Atlantic Basin for the next five years is approximately the same level as predicted for the past two years, which is significantly above the risk averaged over the long term. Although the US has had the good luck to escape hurricanes for the past two years, it faces a high risk of major storms over the next five years.

The US Labor Department's Inspector General released "Mine Safety and Health Administration: Underground Coal Mine Inspection Mandate Not Fulfilled Due to Resource Limitations and Lack of Management Emphasis".  The report found that the Office of Coal Mine Safety and Health (CMSH) did not perform all required inspections at 107 of the 731 underground coal mines across the US last year: 15 percent of the total. Significant inspection and supervisory deficiencies must be addressed by such steps as ensuring that inspection resources are commensurate with mining activity; that all critical inspection activities are documented as performed or not applicable; that field office supervisors certify inspections are thorough and complete; that inspection documentation and supervisory oversight are reviewed under the Accountability Program, and other measures. Agency officials disputed the report, placing all blame on funding rather than personnel, a situation that mining states affected by disasters find unacceptable.

The Army Corps of Engineers released flood risk maps on a block-by-block basis on June 20, but didn't include some technical data, preventing independent assessments of the accuracy of the maps. In a report released 7 November, Corps scientists estimated that the actual benefit the system would provide would be just 6 inches. This week the Corps corrected its corrections. Meanwhile, The Federal Emergency Management Agency's draft flood plain maps for Las Cruces, New Mexico, contain significant errors that could affect insurance payments.

BSI British Standards' "Business Barometer" reports that UK businesses are better prepared to cope with a major business interruption or disaster. They found:
* 71 percent of FTSE 250 companies recognized the importance of business continuity management, 10 percent higher than in 2006.
* 47 percent of companies were prepared for failure in the supply chain compared with 45 percent in 2006 and 18 percent in 2005
* 63 percent were prepared for a catastrophic information technology failure, compared with 51 percent in 2006 and 27 percent in 2005.
* 58 percent of companies believed they would be seriously affected by a disruption in under a day, compared with 46 percent in 2006.

The US Occupational Safety and Health Administration (OSHA) released a final rule on Employer Payment for Personal Protective Equipment. In summary:
"Many Occupational Safety and Health Administration (OSHA) health, safety, maritime, and construction standards require employers to provide their employees with protective equipment, including personal protective equipment (PPE), when such equipment is necessary to protect employees from job-related injuries, illnesses, and fatalities. These requirements address PPE of many kinds: hard hats, gloves, goggles, safety shoes, safety glasses, welding helmets and goggles, faceshields, chemical protective equipment, fall protection equipment, and so forth. The provisions in OSHA standards that require PPE generally state that the employer is to provide such PPE. However, some of these provisions do not specify that the employer is to provide such PPE at no cost to the employee. In this rulemaking, OSHA is requiring employers to pay for the PPE provided, with exceptions for specific items. The rule does not require employers to provide PPE where none has been required before. Instead, the rule merely stipulates that the employer must pay for required PPE, except in the limited cases specified in the standard."

The US Senate approved legislation extending federal support for terrorism insurance. Terrorism Risk Insurance Program Reauthorization Act (TRIPRA) of 2007 will next be reconciled with a version previously passed in the House.  Insurance groups reacted positively to the news, and look forward to final passage. Quick action is necessary as the current legislation expires at the end of December.

Online auction and shopping scams

It is possible to buy almost anything over the internet these days. Unfortunately, scammers can use the anonymous nature of the internet to rip off unsuspecting shoppers.

Scammers can pretend to be selling a product—often very cheaply—just so they can steal your credit card or bank account details. Similarly, they may take your money but send you a faulty or worthless product instead—or even nothing at all.

Most online auction sites put a lot of effort into spotting scammers, which is why scammers will often try to get people to make a deal outside the auction site. They may claim that the winner of an auction that you were bidding in has pulled out, and then offer the item for sale to you. Once they have your money, you will never hear from them again and the auction site will not be able to help you.

Another common trick is for an online auction to be rigged by the scammers. If you are selling a product, the scammer can enter a low bid followed by a very high bid under another name. Just before the auction closes, the high bid will be withdrawn and the scammer’s low bid will win. If you are buying a product, the scammer can arrange for 'dummy bidders' to boost the price up.

Other online shopping scams involve the sale of a product —such as a miracle cure or weight loss product—that does not live up to its claims. It can be very difficult to get your money back in these situations, especially if the other party is based overseas.

If you buy or sell online, you should also be aware of check overpayment scams.

Top Warning signs:
* A product is advertised at a very low price.
* The seller and any initial bidders have a very poor rating on an auction site.
* The other party wants to complete the sale outside of the auction site (if you do this, you lose any protections that the site operator offer to their users).
* The other party insists on immediate payment, or payment by electronic funds transfer or a wire service.
* The online shopping website does not provide adequate information about privacy, terms and conditions of use, dispute resolution or contact details.

* UK Office of Fair Trading (OFT):

The OFT is working with Local Authority Trading Standards Services (TSS) to carry out a web sweep of the UK's top 600 retail websites to ensure that they comply with key requirements of online shopping laws.

The exercise will involve around half of UK Local Authority Trading Standards Services checking whether the most popular shopping websites are meeting key requirements of the Distance Selling Regulations, which provide additional protection for shoppers when buying at a distance, including online.

It is estimated that UK consumers will spend GBP14 billion online this Christmas. However, OFT research has shown that most online shoppers do not know that they have additional protection, and many websites may be breaching regulations by not fully respecting consumers' rights.

In June the OFT published the findings of its internet shopping market study, which found that:

* 28 per cent of the online traders it surveyed were unaware or only slightly aware of the laws applying to internet shopping, and 66 per cent had never sought advice on them
* more than 20 per cent of sites did not provide an email address as required by regulations
* 16 per cent of sites checked did not tell shoppers that they had a an unconditional right to cancel without giving a reason, provided they did so within seven working days of receiving their purchase
* most sites (59 per cent) appeared to impose conditions that could prevent or at least deter consumers from exercising their cancellation rights.

Happy "Cyber Monday!"

We hear the Monday after Thanksgiving is now one of the busiest days—if not the busiest day—of the year for online shopping. That's why some retailers are calling it "Cyber Monday" or even "Black Monday."

And that’s why we’d like to start your online shopping off right with some words to the wise.

Here's our specific advice for shopping safely on the Internet:
* Do your homework on the web retailer. Make sure you're buying items from a reputable and legitimate company. Don't judge the business by its website. Make sure the site has a physical address and a working phone number. Check consumer websites for information about the company.
* When using your credit card for purchases, make sure the website is secure. Look for the tiny padlock icon that symbolizes (but doesn’t necessarily guarantee) a higher level of security. Also, check out the site’s security or encryption software.
* Be very cautious when responding to special offers (especially those that come via unsolicited e-mail) and when dealing with companies or persons outside the country.
* If you’re participating in an Internet auction, read the fine print. Before you bid, learn as much as you can about how the auction works, what your responsibilities are as a buyer, what the seller’s obligations are, and what actions the website takes if a problem occurs. Learn as much as you can about the seller. And don’t give out your social security number or driver’s license number to the seller.

AFTER YOUR PURCHASE

As the holiday shopping season unofficially kicks off this week, about 42 million American households plan to give or receive high-tech electronic products this year.  However, about seven out of eight households don’t fully understand key aspects of their insurance coverage for these purchases, according to a new national survey by Trusted Choice(R) and the Independent Insurance Agents & Brokers of America (the Big "I").

For the survey, respondents were asked if they were going to purchase or receive electronics, including iPods and iPhones, video gaming systems, computers and plasma televisions, during this holiday season.  In addition, when asked, only about one fifth of survey respondents reported ever contacting their insurance agent with questions on coverage for high-tech electronic products when they purchased them in the past.

“With so many people giving and receiving electronics this holiday season, it is important for consumers to understand how to protect these gifts,” says Big “I” President & CEO Robert A. Rusbuldt.  “In fact, any time people acquire an expensive or unusual item, we advise they consult with their Trusted Choice® independent insurance agent. This new research shows us not enough consumers are doing that.”

The survey also presented respondents with five questions about insurance coverage for high-tech home electronics.  An overwhelming seven out of eight households (96 million) answered at least one of these questions incorrectly.

“As our research shows so frequently, most consumers don’t fully understand their insurance policies,” says Madelyn Flannagan, Big “I” vice president for education and research.  “Making matters worse, with the ever-changing technology of these types of electronics, consumers need to keep in mind that policies may not always reflect the latest features.”

The good news for consumers is that most electronic gadgets are typically covered under the standard homeowners or renters policy.  However, there are some common and important exceptions that many consumers don’t understand.  Look out for coverage limitations and exclusions in these situations:

Digitally- downloaded data:  These are not generally covered under the usual homeowners or renters policy.  Consumers need to think about the value of their iTunes, downloads, and other data, as well as the time it would take to recover that material.  Even in cases of fire, windstorms, and theft, when your computer is covered, downloads are not usually included.  Although a few companies now offer some coverage for digital data, that coverage is limited and may not allow for full replacement or re-creation of digital material.  Consumers should consult an independent agent to find out what insurance options and protection they have.  Trusted Choice® independent agents suggest backing up information to multiple locations or to a portable storage device to secure and safeguard that material against any disaster.

Electrical power surges: According to the new survey, more than half (55%) of Americans mistakenly believe that their insurance coverage would protect their electronics in the event of an electrical power surge.  However, the vast majority of renters and homeowners policies exclude sudden loss or damage to electronics from changes in artificially generated electrical current.  Ask your Trusted Choice® independent agent about insurance options including specialty electronics policy and whenever possible, use a surge protector or invest in an uninterruptible power supply (UPS) to protect against power surges or outages resulting from them.

Know your deductible:  For most standard homeowners and renters policies, the usual deductible is higher than the cost of many single electronic gadgets.  For example, if your iPod, cell phone, or portable gaming system is stolen, the replacement cost might not meet your deductible.  About 52% of survey respondents were incorrect by thinking they could usually rely on their insurance policy to recoup this type of loss.  Talk to your agent and discuss the proper deductible for your individual circumstances. Examine your exclusions and know your perils:  Although electronics gear is typically covered under a homeowners or renters policy, the same exclusions apply to these items as to the rest of your policy.  Your electronics will not be covered in cases of flood, earthquake, mudslides, and some other specific disasters or circumstances.  For example, if your new plasma TV falls off the wall because you hung it improperly, or if you drop your new computer while carrying it into your home, you are probably not covered.    In addition, before making a particularly large electronics purchase, consult your independent insurance agent to determine if you need a special policy.

Business use: Homeowners and renters polices were designed for just that-- homeowners and renters use.  Coverage for computers and other electronic items used for business in the home is often very limited (usually $2500 on premises and $250 for items outside of the home).  Discuss purchasing an in-home business policy with your Trusted Choice® agent to make sure that you have the protection you need for any electronics you use for business purposes.

Gift cards:  Holiday shoppers nervous about giving electronics that could be an insurance risk may choose gift cards instead for their friends and loved ones.  They should be aware, though, that most homeowners and renters policies treat gift cards the same as cash, reimbursing just $200 in total, no matter how many cards you may have had lost or stolen.   Be sure and save all receipts and find out the store's own policy for lost or stolen cards at the time of purchase.
